Damaged vinyl from the US; Replacement expectations?

I have purchased a vinyl copy of The Odyssey by Symphony X from the US. However, on arrival side 4 has a series of scratches, ending in a gouge. The disc is unplayable.

What are the obligations of the seller to sort this? Is is reasonable for them to ask me to return the album back to the US from the UK or should they just send me a replacement for the second disc (sides 3 and 4)? Anyone had a similar experience? Seller has already requested a video of the effect of the scratch on playback which I have just sent.

I had a problem with John Coltrane 58 Prestige Recordings Box from Craft.

Many of discs were warped. Via Email, they requested a video recording and upon seeing it, suggested 100 $ refund. I insisted in sending the Box back and get a new one, again via email. They then refunded me the entire sum.

I think sending back and forth may be too expensive for the Company and they are more likely to refund you part or all of the money.

No experience with scratches and US deliveries. May be a bit more problematic…

My son ordered 2 albums from Rhino in the US. On delivery one of the albums was scratched and the other had a damaged sleeve. After sending them photographs of the damage they replaced both albums FOC including shipping costs to the UK. The one with the damaged sleeve is now in my collection. Great service.

My tuppence worth.
I once had an Lp from Music Matters that was very warped.
They wanted proof of its damage so video sent they said they would replace.
And sent out a new disc but no artwork etc just packaging for transport.
Maybe they thought I wanted a freebie.

I had a few problems with LPs I ordered from Acoustic Sounds. They were happy to replace them but only as part of another order.

I’ve been luckier than many with new LP purchases. The 2022 reissue of Lyle Lovett’s Joshua Judges Ruth was the exception. It took three copies before I had one that wasn’t warped and wasn’t excessively noisy.

The vendor (VMP) was very gracious. They asked me to send video / audio of the problems, and then just sent out the replacements the same day. The upshot is that I have three copies of this record, though only one is playable :joy:

Are US import records subject to being a bit ropey then? Can’t remember the last time I had a scratched or damaged new record bought in UK.

I had a very similar problem with that box set and also got a refund which was great as every disc is entirely playable and sounds very good.

Update; supplier has agreed to send a replacement disc but has asked me to make the damaged disc unplayable by either scratching it or using permanent marker! Never heard of this before.

Disc thoroughly trashed with a kitchen knife!

Breaks every record care rule

 thats a new version indeed. Never encountered that before.

Curious: Why does permanent marker make the disc unplayable ?

maybe it just makes it un-sale able?

Ah, yes. Makes sense. Your choice of invalidation reveals a decent amount of anger against the seller :slightly_smiling_face:
